UCard Terms and Conditions (including Privacy Policy)
Introduction
UoN Services Limited UCard membership is governed by the following terms and conditions; it is the member's responsibility to read and understand them. If there is any conflict between what is set out in these terms and conditions and what a member has been told by an UoN Services staff member staff member or its agents, these terms and conditions will prevail.
Every member is responsible for remaining aware of the terms and conditions. Every effort has been made to ensure the information provided to members in relation to UoN Services membership is correct, however UoN Services Limited is in no way responsible or liable for any inaccuracy in the information provided to members concerning the membership program.
These terms and conditions are effective as at the date of publication (February 2011) and UoN Services Limited reserves the right to amend them when necessary.
UoN Services Limited shall use all reasonable endeavours to advise members of any such changes, but shall not be liable in any way for any failure to do so.
Definitions

UoNS: UoN Services Limited ACN No. 121393306, ABN No. 22 121 393 306.

Member: a person who is a current financial member.

Benefits: any of the facilities, services or arrangements offered or available to the member during the period of membership.

Terms and Conditions: these terms and conditions as amended occasionally.

UCard: UoNS’ member card, held by all financial members of the organisation.

GENERAL
UoNS has your permission to contact you with relevant information regarding the program via mail, email or SMS.
You may unsubscribe from the program at any time using the unsubscribe function on any email or SMS communication or by contacting UoNS at info@uonservices.org.au.
You have the right to view and correct or update your personal information by arrangement with UoNS.
UoNS reserves the right to refuse membership at any time at their discretion.
All offers are subject to the individual terms and conditions of the partner and may change or be cancelled at any time without notice. Changes will be published as soon as possible on the UoNS website at www.uonservices.org.au
Partner participants in the UCard Program can change at any time without notice.
In making a purchase or accepting a partner offer, you enter into a contract directly with the partner concerned and not with UoNS.

UONS MEMBERSHIP
Membership of UoNS includes several levels:

Full membership: for University of Newcastle students, giving access to all benefits and services as promoted in each year’s membership listings.

Staff membership: for people who are not University of Newcastle students but are still able to gain access to most benefits and services as promoted in each year’s membership listings.
* Staff members do not have the right to student directorships on the UoN Services Limited Board.
The amount you pay for your UoNS membership is non-refundable after purchase.
UoNS Membership expires on 31 January 2012.

MEMBERSHIP REGISTRATION
If purchasing via the website you must collect your UCard in person at the Hunter Ushop, Shortland Shop, or Bar on the Hill, or UoNS membership registration points (O-Week). If purchasing at The Hunter UShop, Bar on the Hill, Shortland Shop, or designated sites, you will be issued your UCard on site.
A student or staff identification card must be shown upon collection of the Ucard.
The UCard is non-transferable and cannot be used by another person, even if that person has your authority to do so.
You must hold an UCard in order to enjoy the benefits of the Benefits Program as displayed on the UoN Services website. UoNS financial members may be required to show their UCard as proof of membership. A valid UCard shall be considered to be proof of membership for those eligible for UoNS membership.
UoNS is committed to ensuring that the collection, accuracy, use, disclosure, de-identification and destruction of your details comply with the Privacy Act 1988 (Cth) and National Principles for the Fair Handling of Personal Information.

UCARD USE
All UoNS members are entitled to obtain any applicable discounts for goods or services upon presentation of their UCard. Discounts are not available unless a valid UCard is presented at time of purchase or entry.
Entry into an event is subject to the terms and conditions that apply to that particular event (including any imposed by the promoter of that event or the venue owner). Possession of an UCard does not automatically admit an UoNS Member into an event.
You may only use your membership for your own benefit. You may not transfer your UoNS membership, or lend, or otherwise give your membership to another person for their use.
UoNS reserves the right to cancel your membership and/or your membership in the Benefits Program in the event of unauthorised use.
Your UCard may be used as proof of UoNS membership. UoNS reserves the right to deny access to goods and services until membership status is checked on the membership database. UoNS reserves the right to see a student or staff identification card in conjunction with the UCard to confirm validity of membership.

LOST, STOLEN OR DAMAGED CARDS
It is your responsibility to take care of your UCard and keep it secure.
UoNS will replace a UCard if it is lost, or stolen, but will charge a fee for doing so, regardless of the circumstances.

UCARD VOUCHERS
The UCard vouchers are for the use of UoNS members only. The UCard vouchers are redeemable at participating stores only and are subject to the terms and conditions of the vendor as outlined on the voucher.

CANCELLATION AND REFUNDS
The amount paid for membership is non-refundable and non-transferable after purchase. We recommend that you take this into account before purchasing UoNS membership.
No refunds will be given on purchased UoNS membership.

MEMBERSHIP LIMITATIONS
No member is an agent, representative or partner of the UoNS by virtue merely of Membership.
No member has any power or authority to act for or to assume any obligation or responsibility on behalf of UoNS, to bind UoNS to any agreement, negotiate or enter into any binding relationship for or on behalf of UoNS, or pledge credit of UoNS except with the express of written authority of UoNS.

THIRD PARTY OFFERS
Some Benefits require UCard holders to register as a member with third party programs. This is entirely at your discretion and in doing so you may be communicated with directly by the third party, which is no longer within the control of UoNS. You may unsubscribe from these offers at any time by contacting the third party directly.
All Partner offers are subject to the individual terms and conditions of the Partner and may change or be cancelled at any time without notice. Changes will be published as soon as practicably possible on the UoNS website, currently at www.uonservices.org.au.
Partner participants in the Program may change at any time without notice. Notification of changes in Partners will be displayed on the Website as soon as reasonably practicable.
In making a purchase or accepting a Partner offer, you enter into a contract directly with the Partner concerned and not with the UoNS.

INFORMATION AND PRIVACY
UoNS is committed to ensuring that the collection, accuracy, use, disclosure, de-identification and destruction of your details comply with the Privacy Act 1988 (Cth) and National Principles.
UoNS Privacy Policy forms part of these Terms and Conditions. To the extent of any inconsistency, these Terms and Conditions shall prevail.
You have the right to view and correct or update your personal information by arrangement with UoNS via email (info@uonservices.org.au).
UoNS may use your personal information to keep you informed of specials, promotions, events, competitions, discounts and free offers. You will be contacted via email, telephone, SMS and/or post where applicable. You may opt out of these communications paths at any time.
UoNS may use your information for its own planning, research, marketing and product and service development.
UoNS communicates with its members and keeps them informed via a number of communications paths and cannot be held responsible for any member not being aware of a special, promotion, event, competition, discount and/or free offer or any Member failing to take advantage of that offer and/or missing out on an opportunity.
UoNS may share anonymous and aggregated membership information with current or prospective Partners for the purpose of securing better offers for UCard holders, or with data analysis specialists, data mail houses, data processing organisations and specialist call centres for the purposes of improving existing or potential Benefits. When such disclosures are made, your personal information will be protected through confidentiality agreements and/or other contractual obligations.
UoNS may provide your information to: any outsourced service provider to the UoNS; a Partner for the purpose of promoting or using its products or services (and any of its outsourced service providers), regulatory bodies, government agencies, law enforcement bodies and courts, and other parties to whom UoNS is authorised or required by law to disclose information.
UoNS will take all reasonable steps to ensure your personal information is protected from unauthorised access, misuse, modification and disclosure while stored or transmitted by it.
If UoNS already holds any personal information about you, this is because it was obtained from The University of Newcastle with your authorisation when you enrolled with the University, by other means of authorisation, or because it was existing information obtained with permission through your previous UoNS membership registration.
